Nestia Member Automatic Renewal Service Agreement
1. Acceptance and Modification of Terms of Service
This Agreement is an agreement concluded by Nestia regarding the advertising-free service. This Agreement describes the rights and obligations of Nestia and its members regarding the use of the service and related aspects. “Member” refers to the individual or single entity that enjoys the membership service provided by Nestia. This Agreement shall constitute the prerequisite for the use of the service provided by Nestia for any member (individual or unit). The members shall not be entitled to use the service, unless the members accept the terms of this Agreement. The use of this service by members shall be deemed to be binding upon acceptance of the terms and conditions of this Agreement.
2. Service Description
2.1 This service is launched for members that demand for automatic renewals, under the premise that the members have opened this service, in order to avoid losses due to negligence or other reasons resulting in the failure to renew the fees in a timely manner. The member irrevocably authorises Nestia to withhold the fee of the next billing cycle from the balance of the member’s own recharge account, third-party payment account, bank card, and communication account ((hereinafter jointly referred to as “Account”) associated with the member account when the membership validity period is about to expire. The billing cycle includes, but not limited to, month, quarter, year, etc. (similarly hereinafter), which the members can choose according to the billing cycle displayed on the Nestia platform. The premise of the service shall be that the member has bound his/her Nestia member account with the above account and can successfully deduct the funds from his/her account.
2.2 The automatic renewal specifically means the deduction method that, based on the premise of 2.1, Nestia collects the member’s next billing cycle fee through the aforementioned account, and the member shall ensure that Nestia can successfully deduct the fee from the above account. The renewal failure caused by the insufficient balance of the above account shall be borne by the members themselves.
2.3 The members shall be bound by the Nestia Terms of Use when enjoying this service. When the member uses the service, the use behaviour of the member shall be deemed to be the consent of the terms of the service and the various types of publicity issued by Nestia for the service.
2.4 The service provided by Nestia to the members are limited to the use by the members on the Nestia platform. Any behaviours of separating the service provided by Nestia from the Nestia platform by illegal means such as malicious cracking shall not belong to this service as stipulated in this Agreement. All legal consequences arising therefrom shall be the responsibility of the perpetrator, and Nestia will pursue the perpetrator’s legal liability according to law.
3. Rights and Obligations of Both Parties
3.1 Nestia shall be responsible for providing the members with information on the specific conditions of automatic renewal and charging, but not for printing the relevant invoices and forwarding them to the members.
3.2 If Nestia deducts the fee of next billing cycle from the aforementioned account of the member, it shall deduct the payment at the time of opening the automatic renewal and record the payment in the payment record of the member, and at the same time, extend the validity period of the member.
3.3 If there is an error in the deduction process, Nestia and the member should work closely with each other to find out the reasons and bear the losses caused by their own faults; if the losses are caused by the inequality between the two parties, the two parties shall bear the corresponding liability according to the degree of fault; if the two parties fail together but cannot distinguish their own faults, the two parties share equal liability.
3.4 Nestia may change or amend the relevant service contents, rules and terms of this Agreement in accordance with its business development or technical upgrades, etc. Nestia will inform users of the relevant changes or modifications by publicising it on Nestia’s relevant pages, but is not obliged to separately provide individual notices. If the member disagrees with the modification of this Agreement, he/she may cancel the service he/she has acquired and stop using it; if the member continues to use the service provided by Nestia, the member shall be deemed to have accepted all the modifications of this Agreement.
3.5 This service shall be independently selected by the member whether to cancel or not. If the member chooses not to cancel, the member shall be deemed to have agreed to Nestia’s deduction attempt according to certain rules. Once the deduction is successful, Nestia will open the membership service for the next billing cycle for the member.
3.6 If the price of the Nestia service has been adjusted before the automatic renewal, the current effective price shall prevail.
3.7 Nestia shall not charge any fee for the opening of this service by the member, but Nestia shall has the right to decide whether to charge the service itself or adjust the auto renewal cycle and the fee according to business needs or market changes, and publish it on the relevant page.
4. Term of Validity and Termination of Agreement,
4.1 This Agreement shall become effective after the member elects to accept or use the service, until the member terminates the service and terminates when the member is disqualified.
4.2 The member shall have the right to terminate the service at any time in the membership account setting. After the termination of this service, Nestia shall stop providing the service to the member.
4.3 The order that the member has already commissioned Nestia’s automatic renewal before he/she chooses to terminate this service is still valid. Nestia shall not refund the fees deducted based on the order, and the member shall bear the relevant responsibilities.
5. Liability for Breach
If one party breaches the contract, the observing party shall have the right to obtain compensation through the dispute settlement method agreed by both parties.
6. Dispute Resolution and Legal Application
Nestia and the members shall resolve the disputes arising from the implementation of this agreement through friendly negotiation. If the dispute cannot be resolved through consultation, either party shall have the right to submit the dispute to the court for settlement. All matters related to the interpretation, validity, and enforcement of this Agreement shall be governed by the Singapore Act.

2. Price: SGD 1.48/month
3. Payment will be charged to iTunes Account at confirmation of purchase.
4. Apple will deduct payment monthly. With each successful payment, the user will enjoy another 31 days of ad-free service.
5. Go to [Settings] > [Apple ID, iCloud, iTunes & App Store] > [iTunes & App Store] > [Apple ID] > [View Apple ID] > [Subscription], then cancel Ad-Free auto subscription.
6. Any unused portion of a free trial period will be forfeited when the user purchases a subscription to that publication.
